According to the clues of the case transferred from outside the province, the Dezhou Municipal Market Supervision Bureau conducted an on-site inspection of the production site of Shandong Quanbao Biotechnology Co., Ltd. and found 19,125 bottles of beverages infringing the registered trademark exclusive rights of “Tsingtao Beer” and “TSINGTAO” in its finished product warehouse, and will infringe Products are subject to administrative coercive measures for seizure. It was also found out that the parties also produced 21,600 bottles of beverages infringing the exclusive right to the “Snowflake®” registered trademark, all of which have been sold.
After investigation, it was found that the infringing products involved were produced and sold by the parties using recycled old beer bottles, with the registered trademark embossed logos of “Snowflake®”, “Tsingtao Beer” and “TSINGTAO” printed on the bottleneck (not covered), and the illegal business volume was 17,000 yuan. The above-mentioned behavior of the parties violated the provisions of Article 57 of the “Trademark Law of the People’s Republic of China”, and was subject to administrative penalties for infringing the exclusive right to use a registered trademark twice within five years.
In July 2021, the Dezhou Municipal Market Supervision Bureau imposed administrative penalties on Shandong Quanbao Biotechnology Co., Ltd. to stop the illegal acts of infringing the exclusive right of registered trademarks, confiscate 19,109 bottles of infringing beverages, and fined 150,000 yuan.
